Implementation of Supreme Court’s judgement dated 31.10.2013 in WP(Civil) No. 82/2011 in the matter of Shri T.S. R. Subramanian & Others vs. UOI & Others

Subject: Implementation of Supreme Court’s judgement dated 31.10.2013 in WP(Civil) No. 82/2011 in the matter of Shri T.S.R.Subramanian & Others vs. UOI & Others — Parliament Assurance in Rajya Sabha Unstarred Q. No.988, answered on 17.07.2014, on ‘Amendment in Rule 3(3) of All India Service (Conduct) Rules’ — regarding.


The undersigned is directed to state that in reply to part (b) of the above Rajya Sabha Unstarred Q. No. 988 for 17/07/2014, the Parliament was, inter-alia, informed that ‘the directions of the Hon’ble Supreme Court in the PIL filed by Shri T.S.R. Subramanian and others were brought to the notice of the various Ministries / Departments who are the Cadre Controlling Authorities of the Central Civil Services for compliance’. This part of the reply has been treated as an Assurance.

2. It may please be recalled that, following the Supreme Court’s judgement dated 31.10.2013 in WP(Civil) No. 82/2011, the Ministries / Departments were requested to take steps for implementation of the judgement. In view of the above Parliament Assurance, all Ministries / Departments are requested to please send a line in confirmation of the implementation of the above judgement in respect of the Cadre(s) under their administrative control by 20.03.2015 so that the Assurance can be fulfilled. The Cadre(s) under the administrative control may also please be indicated for records.

3. The Ministries / Departments, which are not Cadre Controlling Authorities for any cadre, may also kindly send a communication in this regard for the records of this Department.

CCS (Conduct) Rules – Filing of annual Immovable Property Returns – Dopt Orders 2015

Subject: Central Civil Services (Conduct) Rules, 1964 — Filing of annual Immovable Property Returns – regarding

The undersigned is directed to state that as per various notifications issued by this Department, relating to the Public Servants (Furnishing of Information and Annual Returns of Assets and Liabilities and the Limits for Exemption of Assets in Filing Returns) under the Lokpal and Lokayuktas Act, 2013, the public servant who has filed declaration, information and annual returns of property under the provision of the rules applicable to such public servant, should file the declaration, information and return indicating his/her assets and liabilities, as on 01.08.2014, to the competent authority on or before, 30.04.2015. The notifications are available on the Department’s website at http://persmin.gov.in/Lokpal HomePage From CCIS.asp.

2. The Central Civil Services (Conduct) Rules, 1964, are being amended to align them with the Lokpal and Lokayuktas Act, 2013. Presently, as per the Rule 18(1)(ii) of the Central Civil Services (Conduct) Rules, 1964, every Government servant belonging to any service or holding any post included in Group ‘A’ and Group ‘B’ is required to submit an annual return regarding the immovable property inherited/owned/ acquired/ held on lease or mortgage either in his own name or in the name of any family member or in the name of any other person.

3. It has, inter-alia, been clarified by this Department vide Office Memorandum No. 407/12/2014-AVD-IV(B) dated 13.01.2015 that the requirement of filing returns regarding assets and liabilities under the Lokpal Act is in addition to, and not in supersession of the requirement of filing similar returns under the existing Conduct Rules. In view of this, all Government Servants may be directed as follows:

(i) The annual Immovable Property Return, as on 31.12.2014, under the existing CCS(Conduct) Rules, 1964 is required to be filed on or before 31.01.2015;

(ii) The first return under the Lokpal Act (as on 01.08.2014) should be filed on or before 30.04.2015; and

(iii) The next annual return under the Lokpal Act, for the year ending 31.03.2015 should be filed on or before 31.07.2015.

4. It is, therefore, requested that all concerned may be suitably advised to file the Immovable Property Returns (IPRs) and the return under the Lokpal Act as per the dates indicated above, Further, in accordance with the instruction contained in this Department’s Office Memorandum No. 11013/3/2011-Estt.A dated 11.04.2011, IPRs (to be submitted by 31 st January of each year) shall be placed in public domain by 31 st March of that year. A compliance report in respect of the IPRs filed by Group ‘A’ Officers of the Central Civil Services, as on 31.01.2015, may please be furnished to this Department by 30.04.2015.

5. Similar action may kindly be taken by the authorities controlling services not covered by the Central Civil Services (Conduct) Rules, 1964.

Subject: Amendment to Rule 3 of Central Civil Services (Conduct) Rules, 1964 -Need for code of Ethics and Values of Civil Services.
This undersigned is directed to say that Rule 3 of Central Civil Services (Conduct) Rules, 1964 has been amended vide G.S.R. No 845(E) dated 27 th November,2014 to incorporate the expected standards of the civil services and provide for accountability of civil servants to ensure good governance and better delivery of services to citizen. The above said Notification is also available on the website of this Department at www.persminmov.in/DOPT.asp
2. Consequent to the above amendment, the sub-rule (1) of Rule 3 of Central Civil Services (Conduct) Rules, 1964 now reads as follows:
Every Government servant shall at all times-
(i) maintain absolute integrity;
(ii) maintain devotion to duty;
(iii) do nothing which is unbecoming of a Government servant;
(iv) commit himself to and uphold the supremacy of the Constitution and
democratic values;
(v) defend and uphold the sovereignty and integrity of India, the security. .of
the State, public order, decency and morality;
(vi) maintain high ethical standards and honesty;
(vii) maintain political neutrality;
(viii) promote the principles of merit, fairness and impartiality in the discharge of duties;
(ix) maintain accountability and transparency;
(x) maintain responsiveness to the public, particularly to the weaker section;
(xi) maintain courtesy and good behaviour with the public;
(xii) take decisions solely in public interest and use or cause to use public
resources efficiently, effectively and economically;
(xiii) declare any private interests relating to his public duties and take steps to resolve any conflicts in a way that protects the public interest;
(xiv) not place himself under any financial or other obligations to any individual or organisation which may influence him in the performance of his official duties;
(xv) not misuse his position as civil servant and not take decisions in order to
derive financial or material benefits for himself, his family or his friends;
(xvi) make choices, take decisions and make recommendations on merit alone;
(xvii) act with fairness and impartiality and not discriminate against anyone,
particularly the poor and the under-privileged sections of society;
(xviii) refrain from doing anything which is or may be contrary to any law, rules, regulations and established practices;
(xix) maintain discipline in the discharge of his duties and be liable to
implement the lawful orders duly communicated to him;
(xx) maintain confidentiality in the performance of his official duties as required by any laws for the time being in force, particularly with regard to information, disclosure of which may prejudicially affect the sovereignty and integrity of India, the security of the State, strategic, scientific or economic interests of the State, friendly relation with foreign countries or lead to incitement of an offence or illegal or unlawful gain to any person;
(xxi) perform and discharge his duties with the highest degree of professionalism and dedication to the best of his abilities.”.
3. All the Ministries/Departments are requested to bring the contents of this OM to the notice of all officers and staff working under them.

Dopt orders on submission of Assets and Liabilities Declaration under Lokpal & Lokayuktas Act 2013 by Public Servants

As per the said Act and the Rules framed thereunder, every public servant shall file declarations, information or return, as the case may be regarding his assets and liabilities as on the 31st day of March every year, to the competent authority, on or before the 31st day of July of that year. This is an important difference from the Central Civil Services (Conduct) Rules 1964 and may kindly be noted.

Subject: The Lokpal and Lokayuktas Act, 2013 – Submission of declaration of assets and liabilities by the public servants for each year and placing the same in public domain on the websites of the Ministries/ Departments.

The undersigned is directed to refer to the subject mentioned above and to say that the Government has notified the Public Servants (Furnishing of Information and Annual Return of Assets and Liabilities and the limits for Exemption of Assets in Filing Returns) Rules, 2014 under the Lokpal and Lokayuktas Act. 2013. on 14.07.2014. The same is available on this Department’s website at http://persmin.nic.in/Lokpal_Homepage_New.asp.

2. As per the said Act and the Rules framed thereunder, every public servant shall file declarations. information or return. as the case may be regarding his assets and liabilities as on the 31st day of March every year, to the competent authority, on or before the 31st day of July of that year. It may be noted that as per Section 2(1)(o) of the Act, “Public Servant” means a person referred to in clauses (a) to (h) of sub-sectlon (1) of section 14 of the Act but does not include a public servant in respect of whom the jurisdiction is exercisable by any court or other authority under the Army Act, 1950. the Air Force kt, 1950, the Navy Act. 1957 and the Coast Guard Act. 1978 or the procedure is applicable to such public servant under those Acts.

3. It may also be noted that the definition of public servant covers all Central Government servants (Groups A, B and C). Therefore, all Central Govenmient servants are required to file the declaration. This is an important difference from the Central Civil Services (Conduct) Rules 1964 and may kindly be noted.

4. As per these Rules, the public servants who have filed declarations, information and annual returns of property under the provisions of the rules applicable to such public servants shall file the revised declarations. information or as the case may be, annual returns as on the 1st day of August, 2014, to the competent authority on or before the 15th day of September. 2014. All Ministries/Departments are accordingly. requested to please bring the provisions of the Public Servants (furnishing of Information and Annual Return of Assets and Liabilities and the limits for Exemption of Assets in Filing Returns) Rules, 2014 to the notice of all concerned for compliance.

5. Formal amendment to the Central Civil Services (Conduct) Rules 1964 will be made in due course.

Central govt employees will have to declare family assets


All central government employees will now have to declare their immovable/movable assets and liabilities as well as those of their spouses and dependents by July 31 every year.
The Public Servants (Furnishing of Information and Annual Return of Assets and Liabilities and the Limited for Exemption of Assets in Filing Returns) Rules, 2014 make it mandatory for central government employees to file a statement listing their and their spouse/dependents’ cash in hand; bank deposits; investments in bonds, debentures, shares and units in companies and mutual funds; long-term savings; insurance policies; provident fund; loans and advances; cars/aircraft/yacht/ships; and jewellery.
The declaration must record value of these items as on March 31 and filed with the competent authority by July 31 of that year.
