Subject: Proposed guidelines on reiteration of instructions on verification of claims of candidates belonging to SCs, STs and OBCs for purpose of appointment to posts/services-reg.

It is proposed to reiterate instructions to State Governments/Union Territories regardingverification of claims of candidates belonging to reserved categories for the purpose of appointment to posts & services in Central Government.

2. It is requested that draft instructions may be posted on the website of the Department for inviting comments/suggestions from various stake-holders including M/o Social Justice & Empowerment. Comments/suggestions received up to 8.1.2016 will be considered before the issue of instructions.

Annual income criteria for OBC

(a) whether it is a fact that the annual income criteria for creamy layer for OBCs has to be revised once in every three years;

(b) if so, whether income criteria has been revised only three times since 1993;

(c) the reasons for not complying with the statutory obligation with regard to income criteria for OBCs;

(d) whether National Commission for OBC has recommended recently to increase the creamy layer from Rs. 6 lakhs to Rs. 10.5 lakhs; and

(e) if so, action taken on the above recommendation so far?

(a) to (c): An Expert Committee set up in 1993 recommended for income criteria of Rs. 1 lakh per annum. The Expert Committee observed that since the Rupee value is bound to undergo change, the income criteria in terms of Rupees will accordingly stand modified with the change in value. The modification exercise may, normally speaking, be undertaken in every three years but if the situation demands, an interregnum may be less.

Keeping in view the recommendations of the Expert Committee, Government of India decided to constitute a Review Committee to consider the issue of modification of income criteria and circulated a Cabinet Note in March, 1999. The Cabinet approved constituting the Review Committee in its meeting on 27.11.2001. With the approval of the Hon’ble Prime Minister, the work relating to review the income criteria to exclude cream layer was entrusted to the National Commission for Backward Classes. The National Commission for Backward Classes (NCBC) submitted its report in January, 2004. The income criteria were revised on 9.3.2004. Hence, there was no delay in effecting the first revision of income criteria. NCBC was requested to review in December, 2007 and they submitted their report in July, 2008. After inter-ministerial consultation and the approval of Cabinet, the second revision was effected in October, 2008. Again, in July 2011, NCBC was requested to review the same and they submitted a report in September, 2011. The Cabinet approved on 16.05.2013 the revision of income criteria from 4.5 lakhs to 6.00 lakhs and, accordingly the 3rd revision was effected w.e.f. 16.05.2013.

(d) & (e): The recommendation of the National Commission for Backward Classes in this regard was received and the same has been sent to Department of Personnel & Training.

Backlog Vacancies – 19,676 backlog reserved vacancies of Scheduled Castes, Scheduled Tribes and Other Backward Classes

As per data collected till 31.12.2014, during the period 1.4.2012 to 31.12.2014, 19,676 backlog reserved vacancies of Scheduled Castes, Scheduled Tribes and Other Backward Classes were filled up in Central Government Departments/attached and subordinate offices, Banks etc.

Government constituted a Committee in July 2013 under the Chairmanship of Secretary, Ministry of Social Justice & Empowerment to make an in depth analysis of the reasons for backlog of filling up of reserved vacancies and suggest measures to enhance the employability of reserved category candidates. The Committee submitted its report in May, 2014. Subsequent to the receipt of the recommendations of the Committee, the matter has been examined by this Department. Time bound action has been finalized and intimated to all concerned Departments/ Ministries on 20.11.2014 for implementation. The Action Plan includes study of reasons for non-filling of backlog reserved vacancies; review of prescribed standards, if required; conducting Special Recruitment Drive and conducting pre-recruitment training programmes.

This was stated by the Minister of State for Personnel, Public Grievances and Pensions and Minister of State in Prime Minister’s office Dr. Jitendra Singh in a written reply to a question by Shri Gajendra Singh Shekhawat, Shri Ravneet Singh, Shri Sankar Prasad Datta and Shri S.P. Muddahanume Gowda in the Lok Sabha today.

Revision of Income Tax criteria to exclude socially advanced person / sections ( Creamy layers ) from the purview or the reservation for Other Backward Classes ( OBCs) - income limit raised to Rs 6 lakh.

OBC creamy layer income limit raised to Rs 6 lakh. In a politically significant decision, the Union cabinet on Thursday raised the creamy layer restriction on annual income from Rs4.5 lakh to Rs6 lakh for enjoying the reservation under the Other Backward Classes (OBCs) category.

Dopt Orders on revision of format for OBC Caste Certificate

Government of India Ministry of Personnel, Public Grievances & Pensions Department of Personnel & Training North Block, New Delhi Dated: 30th May. 2014 To, The Chief Secretaries of all the State Governments/Union Territories Subject: Revision of format for OBC Caste Certificate Madam/Sir, The Government of India had issued instructions on 8th September, 1993 vide DoPT OM. No. 36012/22/93-Estt.(SCT) providing for reservation to Other Backward Classes in the services and posts under the Government of India. The format of the Caste Certificate was prescribed vide Annexure A of the O.M. No. 36012/22/93-Estt.(SCT) dated 15th November 1993. In the said format, the then Ministry of Welfare’s Resolution No. 12011/68/93-BCC(C) dated 10th September 1993 was mentioned, which contained the list of castes and communities treated as OBC’s till that time. Since then, a large number of castes and communities have been added to the Central List of OBCs through various resolutions of the Ministry of Social Jusiice and Empowerment. The details of the resolutions subsequent to the Resolution dated 10th September 1993 do not find mention in the existing format. The said format also prescribes that the certificate issuing authority should certify that the candidate does not belong to the persons/sections (Creamy Layer) mentioned in Column 3 of the Schedule to the aforesaid OM. dated 8.9.1993. 2. Representations have been received in this Department wherein candidates belonging to OBC Communities have reportedly faced difficulty in getting the benefits of reservation. This is because of the fact that in the caste certificate issued by the concerned district authorities, although the name of the caste/community is mentioned in the certificate, the specific resolution by which the said caste/community has been included in the Central Listof OBCs is not indicated. 3. Keeping in view such problems faced by the candidates, this issue was examined in consultation with the National Commission for Backward Classes and it has been decided to revise the existing format of OBC Caste Certificate. A copy of the revised format is enclosed(Anuexure). All the certificate issuing authorities are requested to invariably mention the details of the Resolution (Number and Date) by which the castec/community of the candidate has been included in the Central List of OBCs and also to ensure that he/she does not belong to the persons/sections (Creamy Layer) mentioned in Column 3 of the Schedule to the aforesaid O.M. dated 8.9.1993 as amended from time to time. 4. I am to request that the revised format of the Certificate may please be brought to the notice of authorities under the State Governments/Union Territories who are empowered to issue the Caste Certificate. Revision of Income Criterion for OBCs

The Government has increased the income criterion for the persons to avail reservation benefits for Other Backward Classes from Rs. 4.5 lakh to Rs. 6 lakh per annum with effect from 16.05.2013.

The increase in the income limit to exclude Creamy Layer is in keeping with the increase in the Consumer Price Index.

This information was given by the Minister of State for Social Justice and Empowerment, Shri P. Balram Naik in a written reply to a question in Rajya Sabha.
