Clarification regarding stepping up of pay of senior PAs of CSSS w.r.t. their juniors

Subject: Clarification regarding stepping up of pay of senior PAs of CSSS w.r.t. their juniors.

The undersigned is directed to say that several references have been received in this Department from Ministries/Departments seeking advice as to whether the pay of the senior PAs can be stepped up at par with that of their junior Shri Jai Bhagwan, PA of Department Commerce (Supply Division) (now in Ministry of Information & Broadcasting). It has also come to the notice of this Department that many Ministries/Departments have already granted stepping up of pay to their PAs at par with the pay of Shri Jai Bhagwan.

2. The issue of fixation of pay of Shri Jai ghagwan, PA has been examined in this Department. As per DoP&T’s O.M.No.35034/1/97-Estt.(D) dated 04th October, 2012, stepping up of pay is allowed to those officials who got their ACPS benefit prior no 1.1.2006 but are drawing less pay than their juniors, who got it after 1.1.2006 subject to certain conditions. Therefore, in all similar cases, the stepping up of pay of a particular senior who got the ACPS benefit before 1.1.2006 could only be allowed with direct reference to a particular junior who got it after 1.1.2006 and got his pay fixed in terrns of para 2(c) of Department of Expenditilre’s U.O. note No.10/1/2009-IC dated 14.12.2009. Any stepping up of pay is not allowable in a chain-like manner. Shri. Jai Bhagwall got ACP on 01.07.2005 and as such, para 2(c) of Department of Expenditure’s U.O. note No.10/1/2009-IC dated 14.12.2009 would apparently not apply in his case. As such, the pay fixation order No.G-12014/1/2008-Admn dated 09.02.2011 of Shri Jai Bhagwan, PA issued by the Department of Commerce (Supply Division) is not in order.

3. Ministry of I&B were requested to explore the possibility of allowing stepping up of pay to Shri Jai Bhagwan, in case his case is covered under the O.M. dated 04.10.2012. Accordingly, DAVP, Mintstry of I&B, re-examined his case and re-fixed his pay w.e.f. 01.07.2006 by granting stepping up of pay with reference to his junior namely Smt. Promila Bandooni. A copy of DAVP, M/o I&B’s Office Order No.A.20012/07/2012-Admn.l dated 15.07.201.5 regarding re-fixation of pay of Shri Jai Bhagwan, PA of CSSS enclosed herewith.

4. In view of the above, all Ministries/Departments are advised to take further necessary action to accordingly review the stepping up of pay already granted to their PAs in comparison to Shri Jai Bhagwan, PA, CSSS and necessary recoveries of excess amount, if any, be effected. in this regard, from the concerned officials.

As per instructions contained in DOPT’s O.M.No.35034/1/97-Estt.(D) dated 04.10.2012, the pay of shri jai Bhagwan, PA of CSSS Cadre is hereby stepped up w.e.f. 01.07.2006 to an amount equal to the pay of his junior viz. Smt. Promila Bandooni, PA of CSSS cadre of Ministry of Commerce and Industry, Deptt of Commerce (Supply Division) who got he 1st ACP w.e.f. 01.07.2006 in the pay scale of Rs.5500-9000 and fixed as under;

3. The date of next Annual Increment to shri Jai Bhagwan, PA of CSSS cadre will be 01.07.2016, if otherwise admissible.

4. Excess payment, if any______________ made in the form of pay fixation and arrears arising out of the stepping up of pay are subject to recovery in the light of audit objection without further notice.

5. This supersedes all earlier pay fixation orders in respect of Sh.Bhagwan, PA after implementation of the 6th CPC.

Stepping up of pay of direct recruit Assistants at par with promoted UDC – Dopt Clarification on 25.5.2015

Subject: Pay fixation of direct recruit Assistants appointed after 1.1.2006 – Stepping up of pay of DRs with reference to the pay of junior promotee Assistants – Clarification regarding.

The undersigned is directed to draw attention to the issue of stepping up of pay of direct recruit Assistants, appointed on or after 1.1.2006 at par with the pay of the UDCs promoted and appointed to the post of Assistant between 1.1.2006 to 31.8.2008 Whose pay has been fixed in terms of para 2(c) of Department of Expenditure’s U.O. No.10/1/2009-IC dated 14.12.2009.


2. The matter has been examined in this Department in consultation with the Department of Expenditure and they are of the view that as per the CCS (RP) Rules, 2008, the stepping up of pay is allowed if the anomaly in pay, if at all arising, is a direct outcome of fixation of pay in the revised pay scale from the pre-revised scale to the effect that the senior who was drawing higher pay in the pre-revised scale, starts drawing lower pay in the revised scale. However, in the case of direct recruit Assistants appointed on or after 1.1.2006, the direct recruits never drew the pre-revised pay prior to 1.1.2006. Further, Department of Expenditure’s U.O. dated 14.12.2009 relates to fixation of pay in revised scale from pre-revised scale of pay.

3. All the Ministries /Departments are therefore advised to review all the cases wherein stepping up of pay has been allowed to direct recruit Assistants appointed on or after 1.1.2006 with reference to the pay of their junior promotee Assistants. The pay fixation in revised pay structure of such direct recruit Assistants be revised immediately and action be initiated for effecting recoveries of excess payments, if any, as per extant instructions.

Sub : Payment of Salary and other Personal Payments, Salary by Cash on optional basis or through Cheque / Electronically through Bank – instructions regarding.

In continuation of this Directorate O.M. of even No. D-482-558 dated 11.07.2007 wherein clarificatory Orders for disbursement of salary to the staff through POSB Accounts were issued and further O.M. of even No.D-255-326 dated 14.05.2009 wherein decision of Director General (Posts) for disbursement of Pay and Allowances to all employees of Department of Posts through cheque and/or through direct credit to the Salary/Savings Accounts of the employees concerned was conveyed for implementation in letter and spirit.

2. Further, another O.M. of even No. D-473-524 dated 03.10.2012 was issued, wherein decision of DG (Posts) was conveyed that payments of Salary and other personal payments including Retirement/Terminal benefits to all employees of Department of Posts mandatorily be made through Bank including POSB electronically by issuing payment advices with immediate effect. However, in special and exceptional cases, payment of Pay and Allowances including other personal payments to the employees can be made through cheque only with the prior approval of Head of Office/Divisional Head/Head of Postal Accounts office.

3. The case has been carefully re-examined in the light of provisions contained in Ministry of Finance, Gazette Notification dated 30.03.2012 and Department of Expenditure, Controller General of Accounts OM. F. No. 1(1 )/20ll/TA/292 &303 dated 31.03.2012 & 11.04.2012 and it has been decided by DG (Posts), that hence forth, all Government Servants of Department of Posts are permitted to receive their Salary by direct credit to their Bank Accounts or in Cash or by Cheque, at their ‘option’ and payments other than Salary like HBA above Rs. 25000/- and all payments towards settlement of Retirement/Terminal benefits such as Gratuity, Commuted value of Pension, Encashment of Leave Salary, CGEGIS, withdrawal from General Provident fund, etc. by issue of payment advices, including electronically signed payment advices, Cheque / POSB Account or Bank Account.

4. All concerned are requested to issue suitable instructions to all Drawing and Disbursing Authorities working under their administrative jurisdiction for strict compliance.

Clarification regarding Pay fixation on grant of Non-Functional Upgradation to the officers of Organized Group A Services

Subject: Clarification regarding Pay fixation on grant of Non-Functional Upgradation to the officers of Organized Group A Services

The instructions for grant of NFU as per 6th CPC for officers of Organized Group ‘A’ services have been issued in DOPT OM dated 24.04.2009. The terms & conditions for grant of NFU as laid down in Clause-7 of the Annexure to the above said 0.M., prescribe that pay fixation on grant of NFU under these orders will be done as per the provisions of CCS (RP) Rules, 2008 i.e. officers will be granted one increment at the rate of 3% of basic pay and the difference of grade pay will be added to their basic pay. As for the officers posted under the Central Staffing Scheme, they will be granted one increment on account of NFU, but their grade pay will remain unchanged as they are holding a tenure post with a specific grade pay under Central Staffing Scheme.


2. The provisions of FR 22-(I)(a)(1) have been extended to promotions after 01.012006 vide Department of Expenditure O.M. F.No. 1/1/2008-IC dated 13th September, 2008(Clarification No.2). References have been received in this Department seeking clarification on whether the officers on grant of NFU will also be entitled to exercise option to get their pay fixed from the date of grant of NFU or from the date of the next increment.

3. The issue has been considered in consultation with the Department of Expenditure. It is clarified that the officers may be permitted the option for pay fixation as in the case of promotion with the condition that no re-fixation of pay would be allowed at the time of promotion. As per the terms and conditions for grant of NFU all the prescribed eligibility criteria and promotional norms including ‘benchmark’ for up-gradation to a particular grade pay would have to be met at the time of screening for grant of higher pay scale.

The undersigned is directed to refer to this Directorate letter F.No I-IRD/CM/Misc /221/1/2012-13 dated 08.01.2013 circulating the Department of Exependiture’s Office Memorandum No.10/02/2011-E.III/A dated 07.01.2013 communicating the decision of the Government to grant fixation benefit in cases of promotion from onc post to another where the promotional post carries the same grade pay as the feeder post. It is stated in the above referred Office Memorandum that the fixation of pay in such cases shall be as per Rule 13(i) of the CCS (Revised Pay) Rules. 2008.
In this regard. the undersigned is directed to convey the approval of the Departrment of Expenditure on the proposal of the Department seeking fixation of pay under Rule 13 (j) of the CCS (Revised Pay) Rules. 2008 in cases of promotion from (a) Steno Grade-II (till merger of Steno Grade -I and II in the year 2010) to Steno Grade-I and (b) Sr Tax Assistant to Office Superintendent where both feeder and promtional posts are in the same Grade Pay in terms of Department of Exependitures Office Memorandum No 10/02/2011-E.III/A dated 07.01.2013 subject to the condition that fixation of pay in such cases was done as per FR 22(1 )(a)( I) prior to 01.01.2006.

Subject: Fixation of pay on promotion to a post carrying higher duties and responsibilities but carrying the same grade pay.
References hove been received from different Br. AOs and Factories regarding extension of benefit of 3% increment in terms of MoF, Deportment of Expenditure OM No. 10/02/2011-E.III/A dtd 07.01.2013 [click here to view] to those employees who were promoted f rom CM-II to CM-l/AF to JWM/MCM to CM on or after 1.1.2006.

In this connection, it may be stated that as per MoF, Deptt of Expenditure OM No. 10/02/2011-E.III/A dtd 07.01.2013, benefit of fixation of pay under FR 22(1) (a) (l) can be extended when both the feeder and promotional grades were placed in the identical revised pay scales based on the recommendation of the 6th CPC and where the existence of both the erstwhile posts are continued in 6 CPC and at the same time the promotional post also involves assumption of higher responsibilities as envisaged in the MoF OM No. 169/2/2000-lC dtd 24.11.2000.
In this context, it is also significant to mention that after 6th CPC, the posts of CM-II & I and AF & JWM have been merged and replaced by a single grade of CM or JWM with a grade pays of Rs. 4200/- and Rs. 4600/- respectively.  Therefore, promotion between these grades after 6th CPC remains no more available and no movement within merged grade is practically possible and the basic conditions stipulated in G of I, MoF OM dtd 24-11-2000 including assumption of higher charge and existence of feeder and promotion grade are not fulfilled. Thus the benefit of 3% increment for movement from CM-II to CM-I and AF to JWM is not admissible in terms of proviso to para 2 of the aforesaid OM dtd 7.1.2013.
Whereas, in case of movement from MCM to CM, it may be stated that prior to 1.1.2006, the MCM grade was not a hierarchical post. The MCMs were part of HS cadre during 5th CPC. After the restructuring of Artisan cadre w.e.f  1.1.2006, the MCM grade has become a separate hierarchical post and cannot be treated within the strength of the HS. Hence, the condition stipulated under proviso to para 3 of MoF OM dtd 7-1-2013, that the promotional movement should be between two different posts of feeder and promotion post prior to 1 /1/2006 now carrying some grade pay, is not fulfilled in the case of the MCM also w.e.f 01-0.l -2006.
As such, promotionol benefit in terms of MOF OM dtd 7.1.2013 to the CM-l & JWM on their promotion from CM-II/MCM & AF respectively on or after .l.1.2006 may not be considered for admittance.

The undersigned is directed to refer to the O.M. of even number dated 8th  March, 2010. It is clarified, that the provisions of this O.M. are applicable from the January, 2006, the date from which the revised Pay Scales became applicable. 

2. In so far as persons serving in the Indian Audit and Accounts Department are concerned, these orders issue in consultation with the Comptroller and Auditor General of India.

This has the reference to your office letter 127/PM/G II/C-266 dated 17.07.2013 on the subject cited above.
2. In this context, I am directed to convey that GIO (1) below FR 26 provides that where a person has been selected for regular appointment and before formally taking over the charge of the post for which selected person is required to undergo training, training period undergone by such a Government servant whether on remuneration or otherwise counts as duty for the purpose of drawing increments.  This order is applicable only in case of direct recruits.  Further Rule 10 of CCS (RP) Rules, 2008 provides that employees completing six months and above in the Revised pay strucutre as on 01st Jul will be eligible to be granted the increment.  Thus, from the contents of GIO (1) below FR 26 read with Rule 10 of CCS (RP) Rules, 2008, it is clear that "a Government servant who has completed the six month service including training period (whether on remuneration or otherwise) as on 01st Jul will be eligible for increment."  This is applicable only in case of direct recruits.

This issues with the concurrence of DDG (PAF) vide Diary NO. TTL-4-PEA dated 11.10.2013.

Grant of one increment in pre-revised pay scale – OM dated 19.03.2013 – clarification

Subject: Grant of one increment in pre-revised pay scale – OM dated 19.3.2012 – clarification regarding.
 
The undersigned is directed to invite a reference to this Ministry’s Office Memorandum of even no. dated 19.3.2012 which provides that those Central Government employees who were due to get their annual increment between February to June during 2006, may be granted one increment as on 1.1.2006 in the pre-revised pay scale as a one time measure and, thereafter, will get the next increment in the revised pay structure on 1.7.2006.
 
2. As per this Ministry’s OM No. F. No. 1/1/2008-IC dated 30th August, 2008. fitment tables have been prescribed in Annexure-1 thereto, specifying the stages of revised pay in the revised pay band with reference to each stage of pre-revised pay in various pre-revised pay scales. As per the fitment tables, the stage of revised pay in the pay band has been mentioned at the same stage in respect of two consecutive pre-revised stages of pay in cases of certain pre-revised scales.
 
3. This Ministry has been receiving references as to whether in cases where the fitment table provides for the same revised stage in case of two consecutive pre-revised stages in a particular pre-revised scale of pay, the  benefit of bunching is admissible after grant of one increment in the pre-revised pay scale by virtue of this Ministry’s OM dated 19.3.2012.
 
4. The matter has been considered and it is clarified that Fitment Table contained in the aforesaid OM dated 30.8.2008 is to he strictly followed for fixation of pay in the revised structure without any deviation.
 
5. In cases where the stages of fixation of pay in the revised pay band as per fitment table contained in the aforesaid OM dated 30.8.2008 provides for the same revised stage in the Pay Band with reference to two consecutive stages of pre-revised pay in the corresponding pre-revised scales, then in such cases due to application of this Ministry’s OM dated 19.3.2012, there will be no change in the revised pay as on 1.1.2006, if the revised stage with reference to the pre-revised pay after accounting for one increment in the pre-revised scale does not undergo any change as per the Fitment Table. It is also clarified that no further bunching will be allowed in such cases and no re-fixation of pay will be admissible in the revised pay as on 1.1.2006.
